Trial update

Here’s the latest on the saga of Cal’s proposed student-athlete facility. A hearing was held today for the university to state its case that the injunction against construction of the center should be lifted immediately. Judge Barbara Miller didn’t lift the injunction, but it appears likely she may do so soon. The big question is whether the plaintiffs in the case will appeal.

    The article mentions its costing the university $47,000 a day “on construction delays and nearly round-the-clock police and security at the oak grove because of protesters.” So, the next time the university is forced to raise fees on students to go there, instead of pointing fingers at the sports department, blame the city, et al for their lawsuits and the protesters for their time and resource-wasting protest.

    Whether the plaintiffs appeal depends on whether the judge requires them to put up a bond. The university has asked the plaintiffs to put up a $1.5 million-a-month bond if they appeal. I believe that is up the judge to decide. Also, this is why the university has been disclosing the costs it has been incurring in construction delays and policing.

    So while it appears the judge is ready to rule in favor of the university, the real question is what kind of bond, if any, the plaintiffs will be required to post. If it is non-trivial, the plaintiffs will not take the financial risk and will not appeal.
