A Zander Drive resident who took the city of Orinda to small claims court over the conditions at a city-owned house on the street has been awarded a $1,575 judgment.
Joseph Moran argued that he deserved compensation for the “loss of enjoyment” of his neighborhood that he suffered because of the hazards at 106 Zander Drive — including rats, mosquitoes and trespassers.
City officials said they have largely addressed the problems at the house, which the city owns as the result of a lawsuit settlement.
They put an alarm on the home, hired a pest control company to trap rats, and had the county come in to deal with the mosquitoes. The city is also in the process of doing a geotechnical study on how to stabilize the slide-prone Zander Drive lot in the hopes of selling it.
Moran was asking for $7,500 plus court costs, and received a judgment for $1,575, according to court records.
