Marianne Payne, the mother of Joe Loudon, the 16-year-old Miramonte student who died at a party in Orinda in April, has filed a wrongful-death lawsuit against several people involved in the party that her son died at.
Patrick and Alexandra Gabrielli were the kids responsible for organizing the party at the home of their parents. Payne has named both of the Gabriellis, as well as their parents, Scott and Isabel Hamilton, in the lawsuit. Another teenager who purchased alcohol for the party with a fake ID was also named in the lawsuit.
Although the suit seeks an unspecified monetary amount, it does claim that it is for economic damages related to the burial of Loudon and that Payne is suffering from the lack of comfort, moral and financial support from her son.
Loudon’s father declined to be a part of the lawsuit.

I feel sorry for the family. Losing a loved one particularly a minor child is extremely difficult for the parents. I hope and pray that Mrs.Payne is able to cope with this terrible tragedy.

So tragic for the young people who were around him when he died. Their behaviour reflects a local culture bereft of values. They attend a candlelight vigil and shed tears, but select the person who supplied the liquor to be football team captain. They’ll grow up, rationalize this away, and convince themselves that they’re good people. The rest of the community will stay mum, and refuse to come forward. Very sad for our society.

YLWC-you do not know what you’re talking about. everyone who was around him did the best they could to try and help him. cpr was given and the police were called. alcohol was not the cause of death so that has nothing to do with it. the boy who actually did provide the alcohol is now in a treatment center and lives nowhere near here. The boy who was elected the captain is one of the most amazing people i know. i find it repulsive that you can blame his friends, when you have no idea what we’re also going through. please do your research and think about everything before you say things
