Glover demands retraction and apology

Supervisor Federal Glover of Pittsburg, through an attorney, is asking challenger Erik Nunn of Oakley to “cease and desist” in the distribution of campaign mailer that contained false and misleading information about the incumbent. (Click here to see my blog entry and a copy of the mailer.)

Glover is also asking Nunn for a public apology and and retraction.

Glover, Nunn and three additional challengers (Gary Agopian, Mary Rocha and Don Parscal) are running for county supervisor in District 5 in Tuesday’s election.

Dear Mr. Nunn:

This office represents Contra Costa County Supervisor Federal Glover. This letter constitutes Mr. Glover’s demand that you immediately cease and desist from all further publication, distribution, and dissemination of the enclosed brochure. By this letter, you are hereby put on notice that the statements, impressions, and representations contained in that brochure are false and libelous under California Civil Code sections 45 and/or 45a. Mr. Glover further demands that you and your campaign issue an immediate public apology and retraction of the brochure.

As reported in today’s edition of the Contra Costa Times, the brochure at issue “contains major misstatements and false impressions.” Lisa Vorderbrueggen, Anti-Glover Mailer False, Misleading, Contra Costa Times, May 30, 2008 at Page A3. Foremost among those “major misstatements” is that Mr. Glover failed to pay his bills for garbage service on his properties, and left taxpayers to do so. That assertion is absolutely false, as was reported in the Contra Costa Times. We believe that these, and other assertions in the brochure, were published by you and your campaign with full knowledge of their falsity, or with a reckless disregard for the truth.

Your publication of this brochure constitutes not only a breach of your common law duties to Mr. Glover, but also a breach of your ethical duties to the public. Be advised that Mr. Glover intends to pursue all legal remedies available to him in connection with the brochure.

You are again urged to mitigate further injury to Mr. Glover by immediately issuing a public apology and retraction.

    What a joke. Glover has no legal leg to stand on. His campaign put out false information about Nunn, stating he harrassed a gay co-worker – WHO WASN’T GAY! Besides, Glover is the one who broke the law by obtaining the sealed file of two former county employees during his 2004 reelection campaign. That’s on top of the lie he told the Times about the cocaine he had in his possession during his first DUI. Desperate move by a desperate politician who is going to lose.

    Two loose canons firing back and forth. East County is full of hate, decite, and backstabbing. I cannot wait until this is over. The real issues are serving the people/taxpayers of the county. The taxpayers and citizens should be ashamed of both candidates.

    I’m sure Nunn’s attorney will be researching and citing the California Anti-SLAPP suit law.

    Unfortunately, both the Glover and Nunn campaigns, as well as their Independent Expenditure (IE) supporters, have brought their campaigns to new lows which shows that neither of them deserve to be elected.

    Factual pieces of mail, positive or negative, are always welcomed. If Nunn fabricated the truth and mislead voters then it needs to be legally addressed. Steve-o – so are you saying it’s okay to harrass a non-gay person? Now, you are being mean.

Nunn’s actions are so bad, but it’s OK for Glover to be arrested for driving drunk twice and possessing cocaine during one of those arrests? The two don’t compare! I find it interesting you want to ignore that and the fact Glover, as a sitting Supervisor, abused his authority by obtaining a sealed file of a former county employee and made its contents public in his effort to get reelected. Hopefully the other side of the story on Nunn’s prank will be made public before the Fall election is over. Perhaps Arne Simonsen is correct and a lawsuit is necessary.

    I’m disappointed that as a member of Republican leadership, you could have sympathy for Erik Nunn. Now don’t get me wrong, Glover has his faults…but you better than anyone should see that Nunn may be the second coming of Mark DESAULNIER…a turncoat, who has sold out to the unions and special interest.
    Let’s not forget what M.Yaz says…Continue to give Gary Agopian support…he is the best choice to take on the incumbent.
